These Terms of Service ("Terms") govern your use of the Sawtooth Consignment service (the "Service"), operated by Sawtooth Consignment ("we," "us," or "our"), a small business located in Nampa, Idaho. By creating an account, submitting cards, or otherwise using the Service, you agree to these Terms in full. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years of age and legally capable of entering into a binding contract in your jurisdiction to use the Service. By using the Service, you represent and warrant that you meet these requirements. We do not knowingly collect information from or provide services to persons under the age of 18. If we become aware that a user is under 18, we will terminate their account.
2. The Service
Sawtooth Consignment is a trading card consignment service for sports cards, Pokémon, and other trading card games (such as Magic: The Gathering, Lorcana, and One Piece), raw or professionally graded. We list your cards on eBay as auctions, handle listing creation, photography, buyer communication, packing, and shipping, and pay you a share of each completed sale. We are not a grading service, authentication service, or card dealer; we act solely as your consignment agent for purposes of listing and selling on eBay.
We may decline any card, submission, or account at our sole discretion, including before or after a shipment arrives. If we decline cards you have already shipped, Section 3.4 (Ineligible Cards) governs their handling.
3. Consignment Terms
3.1 Ownership and Authorization
- You retain ownership of your cards until they are sold.
- You represent and warrant that: (a) you are the lawful owner of all cards you consign; (b) the cards are not stolen, subject to any lien, claim, or dispute; and (c) the cards are not counterfeits, reproductions, or otherwise misrepresented.
- Once a card is listed, you authorize us to accept the highest bid received, subject to any reserve price agreed to in writing in advance.
- Your listing authorization is irrevocable once we receive your cards. Except as provided in Section 13 (Termination), consigned cards cannot be recalled and remain in our listing rotation until they sell (see Section 3.3).
- If a card is later found to be counterfeit, stolen, or misrepresented, you agree to indemnify us fully for any resulting losses, costs, buyer refunds, or legal fees.
In plain terms: consignment with us is one-way. Send us the cards you're ready to turn into cash — once they're here, they stay in rotation until they sell.
3.2 Cards Processed As Received — No Alteration Policy
WE PROCESS ALL CARDS EXACTLY AS WE RECEIVE THEM. This means:
- We will NOT remove price stickers, labels, tape, or any other adhesive material applied to your cards before submission.
- We will NOT clean, polish, press, alter, trim, or otherwise physically modify your cards in any way.
- We will NOT remove protective sleeves, top loaders, or holders unless necessary for photography, at which point we handle your cards with standard reasonable care.
- Any sticker, marking, damage, defect, or condition present on a card when we receive it will be reflected in the listing photos and, where material, in the listing description.
- We photograph cards in the condition received. Our photography represents the card's condition at the time of intake. We are not responsible for any buyer disputes arising from pre-existing conditions, stickers, or markings that were present on the card when you submitted it.
In plain terms: if you hand us a card with a $0.50 sticker on it, we will photograph and list it with that sticker on it. It is your responsibility to prepare your cards before submission.
3.3 Relisting and Unsold Cards — One-Way Consignment
- Each card is listed as an auction. If a card receives no winning bid during a listing cycle, an unsold fee of $0.99 per card, per listing cycle applies (see Section 4).
- You expressly authorize us to relist unsold cards, at our discretion as to timing, format, and starting price, on a recurring basis until each card sells. A card may accrue an unsold fee for each completed listing cycle in which it does not sell.
- We do not return unsold cards in the normal course of business. Consigned cards remain in our listing rotation until sold. The only circumstances in which consigned cards are returned are described in Section 13 (Termination).
- Accrued unsold fees are deducted from your balance or offset against future sale proceeds.
3.4 Ineligible Cards
- Cards we determine to be counterfeit, damaged beyond reasonable listing, in violation of eBay policies, or otherwise ineligible for listing will be flagged and you will be notified.
- Counterfeit or unlawful items will not be returned. We may retain, surrender to authorities, or destroy suspected counterfeit or unlawful items as we determine appropriate or as the law requires, without compensation.
- For other ineligible cards (for example, cards too damaged to list), you may request return within 30 days of our notice. Return shipping and handling costs are your responsibility and will be deducted from your balance or must be prepaid.
- If we cannot reach you, or you do not request return and arrange payment of return costs, within 30 days of our notice, the ineligible cards are deemed abandoned and we may dispose of them at our discretion.
3.5 Listing Format and Scheduling
- The format, duration, starting price, reserve (if any), scheduling, and relisting of all auctions are at our sole discretion unless otherwise agreed in writing.
- Once a card is listed, we may not be able to cancel or retract the listing prior to sale.
- We do not guarantee any specific sale price, sale timeline, or buyer for any card.
3.6 eBay Platform Compliance — Prohibited Practices
Because all sales are conducted through eBay, both we and our consignors are bound by eBay's User Agreement and Seller Policies. We take this obligation seriously and enforce it without exception.
THE FOLLOWING PRACTICES ARE STRICTLY PROHIBITED AND CONSTITUTE AN IMMEDIATE BREACH OF THESE TERMS:
- Shill Bidding — You may not bid on your own listings, direct friends, family members, or any associated accounts to bid on your listings, or engage in any coordinated bidding activity intended to artificially inflate a sale price. Shill bidding is a violation of eBay's policies and may constitute fraud under applicable law.
- Bid Manipulation — You may not contact buyers directly to influence, retract, or negotiate bids outside of eBay's platform.
- Feedback Manipulation — You may not offer incentives, payments, or threats in exchange for positive feedback, or retaliate against buyers who leave neutral or negative feedback.
- Listing Misrepresentation — You may not request that we describe a card in a way that is inaccurate, misleading, or omits material defects. We will list cards accurately and honestly as required by eBay policy and applicable consumer protection law.
- Off-Platform Transactions — You may not use information about buyers obtained through our eBay listings to contact those buyers and solicit transactions outside of eBay.
- Any Other eBay Policy Violation — You may not request or encourage us to take any action that would violate eBay's then-current User Agreement, Seller Policies, or Listing Policies.
If we receive a request from a consignor that we believe would violate eBay's policies, we will refuse it. If a consignor engages in or is found to have engaged in any prohibited practice above, we reserve the right to:
- Immediately suspend or terminate the consignor's account;
- Cancel any active listings associated with the consignor;
- Withhold payouts pending investigation;
- Report the conduct to eBay and, where legally required, to relevant authorities; and
- Seek indemnification for any losses, fines, penalties, or account restrictions imposed on us by eBay as a result of the consignor's conduct.
In plain terms: we run a clean, honest operation. We will not inflate bids, misrepresent cards, or help you game the system in any way. Any request to do so ends the relationship immediately.
4. Fees and Your Share
Our current fee structure is as follows. All fees are deducted from your proceeds or balance before payout.

- The listing fee is deducted from your share per card sold. The unsold fee accrues per card, per completed listing cycle without a sale (see Section 3.3), and is deducted from your balance or offset against future proceeds.
- If you purchase optional services through us (for example, an inbound shipping label — see Section 6.1), those charges are stated at the time of purchase.
- We reserve the right to update our fee structure. Any changes will be communicated to active consignors with at least 30 days' advance notice. The fee rate in effect at the time your package is received by us is the rate that applies to your submission.
5. Payouts, Balance, and Adjustments
5.1 Payout Methods
- Payouts are made through third-party payment platforms we support — currently PayPal (including payouts to Venmo), and in some cases other methods we agree to in writing (such as a manual transfer). The platforms we support may change over time.
- To receive a payout, you must provide a valid payout destination (for example, the email address or handle associated with your PayPal or Venmo account). You are responsible for the accuracy of your payout destination. We are not responsible for funds sent to an incorrect destination that you provided.
- Your use of any payment platform is governed by that platform's own terms and privacy policy, which are separate from ours. We are not responsible for delays, holds, restrictions, fees (such as the platform's optional instant-transfer fees), or account limitations imposed by the payment platform on your account.
- You may request a payout of your available balance at any time. Payout requests may be processed automatically or may be subject to review (see Section 5.3). Once we initiate a payout, the time for funds to arrive depends on the payment platform and is outside our control.
- If a payout is unclaimed and returned to us by the payment platform (for example, because no account exists at the destination you provided), the amount is restored to your balance and we will notify you.
5.2 Refunds, Reversals, and Negative Balances
- All sales are made through eBay and are subject to eBay's policies, including the eBay Money Back Guarantee. A sale may be refunded, reversed, or canceled under those policies regardless of fault.
- If a sale is refunded or reversed, the sale is unwound and your share of that sale reverses accordingly. We may deduct the reversed amount from your available balance, and if your balance is insufficient, offset it against your future proceeds.
- If your account balance becomes negative and there are no future proceeds to offset it within 90 days, we may invoice you for the difference.
- Chargebacks or payment disputes you initiate against legitimate charges (for example, a shipping label you purchased) may be deducted from your balance and are grounds for account suspension.
5.3 Holds, Unclaimed Balances, and Records
- We may hold or delay a payout for a reasonable period where necessary to complete a fraud review, investigate suspected policy violations (see Section 3.6), or cover the reversal window on recent sales. We will communicate the reason for any hold where we lawfully can.
- If you have no valid payout destination and do not respond to our attempts to reach you for 90 days, your balance may become subject to applicable Idaho unclaimed property law.
- Your portal shows a running record of your sales, fees, and payouts. Transaction records are deemed accurate unless you dispute them in writing within 60 days of the transaction appearing in your portal.
5.4 Taxes
- You are solely responsible for any taxes owed on your consignment proceeds. We recommend consulting a tax professional regarding the treatment of proceeds from the sale of your property.
- We will provide transaction records available in your portal to support your own reporting. Where the law requires, we or our payment platform may issue tax forms (such as a Form 1099) and may request the taxpayer information needed to do so; you agree to provide accurate information when requested.
6. Shipping and Risk of Loss
6.1 Shipping Cards to Us
- You bear the entire risk of loss or damage while your cards are in transit to us. We are not liable for any damage, loss, theft, or delay that occurs during shipping to our facility, regardless of the carrier used.
- We do not insure inbound shipments or consigned cards. We strongly recommend using tracked packaging, and if a shipment is valuable to you, purchasing insurance through your carrier. If you ship without insurance, you do so at your own risk.
- If we offer the option to purchase an inbound shipping label through the Service, we act only as a facilitator between you and the carrier: the price is stated at purchase, risk of loss in transit remains with you, and any optional carrier insurance you select is a contract between you and the carrier — we do not underwrite, guarantee, or adjudicate carrier insurance claims, though we will reasonably assist you in filing one.
- If a package arrives visibly damaged, we will document the condition with photographs upon receipt and notify you promptly.
6.2 Shipping Cards to Buyers — Carrier Liability Disclaimer
ONCE WE DELIVER A PACKAGE TO THE POSTAL SERVICE OR OTHER CARRIER FOR SHIPMENT TO A BUYER, WE ARE NOT RESPONSIBLE FOR ANY LOSS, DAMAGE, DELAY, OR MISDELIVERY CAUSED BY THE CARRIER.
- We pack all sold cards with reasonable care using appropriate protective materials.
- Damage, loss, or delay that occurs after we hand a package to USPS, UPS, FedEx, or any other carrier is the sole responsibility of the carrier and is not attributable to Sawtooth Consignment.
- We will assist in filing a carrier insurance claim if insurance was purchased, but we do not guarantee reimbursement from the carrier, and we are not liable for any carrier denial of a claim.
- We will not issue refunds or additional payouts to you based on buyer complaints arising solely from carrier damage or loss after the package left our possession.
In plain terms: Once USPS (or another carrier) picks up the package, it is in their hands. Any damage that happens in the mail is between you, the buyer, and the postal carrier. We are not responsible for what happens after we drop it off.
6.3 Drop-Off — Damage Disclaimer
IF YOU DELIVER CARDS TO US IN PERSON (DROP-OFF), THE FOLLOWING APPLIES:
- We will document the condition of cards at the time of intake where reasonably practicable.
- We are not responsible for any pre-existing damage, defects, or conditions present on cards at the time of drop-off.
- You acknowledge that trading cards are inherently fragile collectibles and that normal handling during the listing and photography process may carry inherent risk. We exercise reasonable care but cannot guarantee zero incidental contact or movement.
- Claims of damage allegedly caused by us during drop-off must be raised within 48 hours of drop-off, must be supported by clear evidence that the damage was not pre-existing, and are subject to our review at our sole discretion.
7. Our Care of Your Cards While in Our Possession
- While your cards are physically in our possession and not in transit, we will maintain reasonable care to protect them from foreseeable harm.
- We are not liable for losses resulting from events beyond our reasonable control, including but not limited to: fire, flood, natural disaster, power outage, burglary, or other force majeure events.
- We do not carry insurance on consigned inventory on your behalf. If you wish to insure your cards for their full value while in our possession, you are responsible for obtaining your own coverage.
- Our maximum liability for any damage to your cards while in our possession (excluding carrier transit) is limited as described in Section 11 (Limitation of Liability). You acknowledge that this limit applies regardless of the value of the cards you consign. Do not consign cards whose uninsured loss you are unwilling to bear.
- Cards you believe to be worth more than $1,000 individually require our prior written agreement before submission. We may return (at your cost) or decline any high-value card submitted without prior arrangement.
8. Account Responsibilities
- You are responsible for maintaining the confidentiality of your account credentials. You agree not to share your password or allow others to access your account.
- You must provide accurate and complete information when creating your account and keep it up to date.
- One account per person. Automated accounts, bots, and shared accounts are prohibited.
- You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.
- We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraud, or whose users engage in abusive, threatening, or harassing behavior toward our team.
9. Intellectual Property
All photographs, listings, copy, and content created by Sawtooth Consignment in connection with the Service are our property. You may not reproduce, copy, or use our listing photography or content without our express written permission. Nothing in these Terms grants you any rights in our brand, trademarks, or other intellectual property.
10. Electronic Communications
By creating an account and using the Service, you consent to receive electronic communications from us, including emails, account notifications, and payout confirmations. You agree that electronic communications satisfy any legal requirement that communications be in writing.
11. Disclaimers and Limitation of Liability
11.1 No Guarantees
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE ANY SPECIFIC SALE PRICE, SALE TIMELINE, BUYER, OR OUTCOME FOR ANY CARD CONSIGNED WITH US. WE DO NOT GUARANTEE UNINTERRUPTED, ERROR-FREE OPERATION OF OUR WEBSITE OR SYSTEMS.
11.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SAWTOOTH CONSIGNMENT'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE — WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER THEORY — SHALL NOT EXCEED THE LESSER OF: (A) THE TOTAL FEES WE HAVE COLLECTED FROM YOUR ACCOUNT IN THE 90 DAYS PRECEDING THE CLAIM; OR (B) FIVE HUNDRED DOLLARS ($500). THIS LIMIT APPLIES REGARDLESS OF THE ACTUAL OR CLAIMED VALUE OF ANY CONSIGNED CARD.
IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF DATA, OR LOSS OF GOODWILL, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Note: Some states do not allow the exclusion or limitation of certain damages. If you are in such a state, some of the above limitations may not apply to you.
12. Indemnification
You agree to indemnify, defend, and hold harmless Sawtooth Consignment, its owners, employees, agents, and representatives from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your breach of these Terms; (b) your misrepresentation regarding ownership or authenticity of consigned cards; (c) any third-party claim arising from a card you consigned being counterfeit, stolen, or infringing any third-party rights; (d) your violation of any applicable law; or (e) any eBay policy violation you directed, requested, or caused us to commit.
13. Termination
- Either party may terminate this agreement (that is, close the account relationship) at any time with written notice. Termination is the only mechanism for the return of unsold cards — individual cards cannot be recalled while the relationship is active (see Section 3.3).
- Upon termination, cards already listed complete their current listing cycle; sold cards settle normally.
- Remaining unsold cards will be returned to you at your cost — actual return shipping plus a reasonable packing and handling fee, deducted from your balance or prepaid by you. We will provide the cost before shipping.
- Abandonment: if, within 60 days of termination, you have not provided a return address and arranged payment of return costs (or we cannot reach you at your account email), the remaining cards are deemed abandoned and we may dispose of them at our discretion, with any sale proceeds credited to your balance net of our fees and costs.
- We will pay out your remaining available balance upon termination in accordance with our normal payout process.
- We may suspend or immediately terminate accounts involved in fraud, chargebacks, misrepresentation, eBay policy violations, or abusive conduct without prior notice.
- Sections 4 (Fees), 5 (Payouts and Adjustments), 6 (Shipping and Risk), 11 (Limitation of Liability), 12 (Indemnification), and 14 (Disputes) survive termination.
14. Governing Law and Disputes
- These Terms are governed by the laws of the State of Idaho, without regard to its conflict-of-law provisions.
- Any dispute arising out of or relating to these Terms or the Service shall be resolved in the state or federal courts located in Canyon County, Idaho. You consent to the exclusive jurisdiction of those courts. Either party may instead bring an individual claim in small claims court where its requirements are met.
- Class Action Waiver: to the maximum extent permitted by law, any dispute will be brought in the parties' individual capacities only, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
- Before initiating any legal proceeding, you agree to first contact us at [email protected] and give us 30 days to attempt to resolve the dispute informally. We agree to respond within that period.
15. Changes to These Terms
We reserve the right to update or modify these Terms at any time. When we make material changes, we will: (a) post the updated Terms with a new effective date; and (b) notify active consignors by email at least 30 days before the changes take effect for material changes. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to revised Terms, you must stop using the Service and notify us so we can complete termination under Section 13.
16. Miscellaneous
- Entire Agreement: These Terms constitute the entire agreement between you and Sawtooth Consignment with respect to the Service and supersede any prior agreements or understandings.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
- No Waiver: Our failure to enforce any provision does not constitute a waiver of our right to enforce it in the future.
- No Agency: Nothing in these Terms creates a partnership, joint venture, employment, or franchise relationship between you and us.
- Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights freely.
